These Terms of Service ("Terms") govern your access to and use of Melingva. By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use Melingva.
1. Acceptance
Melingva ("we", "us") is the language learning service operated by the individual identified in our Legal Notice . These Terms constitute a legally binding agreement between you ("you", "user") and Melingva.
Users under 15 must have the consent of a parent or legal guardian to use the service. By creating an account, you confirm that this condition is met.
2. The service
Melingva is a vocabulary learning application using spaced repetition to help you build long-term language skills. We offer a free tier with limited access and a premium subscription with unlimited access to all content and features.
We reserve the right to modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible. We are not liable for any modification, interruption, or discontinuation of the service.
3. Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately at melingva@proton.me if you suspect unauthorized access.
Accounts are strictly personal. Sharing your account credentials with another person is prohibited. Creating multiple accounts to bypass free-tier limitations is prohibited. Violations may result in immediate suspension without refund.
4. Subscription & billing
Premium access is available through a paid subscription billed monthly or annually. Prices are in euros (EUR), inclusive of applicable taxes.
Automatic renewal
Subscriptions renew automatically at the end of each billing period at the price shown at purchase, unless you cancel beforehand.
Payment
Payments are processed securely by Stripe. Melingva does not store your payment card details.
Cancellation
You may cancel your subscription at any time from your account settings. Access continues until the end of the current billing period. No partial refunds are issued for unused time, except as described in the refund policy below.
5. Refund policy
Under EU consumer law (Directive 2011/83/EU), you have a 14-day right of withdrawal from the date of purchase. To exercise this right, contact us at melingva@proton.me before the 14-day period expires. If you have already started using the premium features during this period, your right of withdrawal may be lost under the conditions set out in Article 16(m) of the Directive.
How to request a refund: email melingva@proton.me from your account email address with the subject "Refund request", within 14 days of purchase.
Processing: we review requests within 5 business days. Approved refunds are returned to the original payment method within 5–10 business days.
Renewals: we do not refund subscription renewals if you failed to cancel before the renewal date, except in the case of billing error.
Service outages: in the event of a significant technical failure on our end, we will evaluate refund or credit requests case by case.
6. Acceptable use
You agree not to:
- Use the service for any unlawful purpose
- Attempt to reverse-engineer, scrape, or extract content from the platform
- Interfere with or disrupt the service or its infrastructure
- Share, resell, or sublicense access to your account
- Attempt to circumvent free-tier limitations through multiple accounts or other means
Violations may result in immediate account suspension without refund.
7. Intellectual property
All original content on Melingva - including the sentence corpus, interface design, and software - is the property of Melingva or its licensors. Your subscription grants you a personal, non-transferable, non-exclusive licence to use the service for your own learning purposes only.
8. Limitation of liability
The service is provided "as is". To the fullest extent permitted by law, Melingva is not liable for indirect or consequential damages arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms limits liability for fraud, gross negligence, or rights that cannot be excluded under applicable French consumer law.
9. Termination
You may delete your account at any time from your account settings. We may suspend or terminate access immediately in case of a breach of these Terms. Upon termination, your right to use the service ceases and your data will be handled as described in our Privacy Policy .
10. Changes to these terms
We may update these Terms from time to time. We will notify you of significant changes by email or by a notice in the app at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by French law. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of France. EU residents may also use the European ODR platform at ec.europa.eu/consumers/odr.
